Do you know what the law calls people born in the United States? Citizens. Brian is either engagement farming or is inept. HHS allows for foreign documents for the PARENT’S identification to get a birth certificate for the citizen child.

Four Qs and As on the $103,265 fee USCIS is proposing be paid with any H-1B petition subject to numerical limits. Does USCIS credibly show how 85,000 cap-subject petitions will continue to be filed annually? No. Did USCIS frame its proposal's success as contingent upon continuing to meet the annual cap? Sure did. Does USCIS have authority to collect fees from H-1B employers to cover the State Department’s transportation of refugees being resettled in the US, wage and hour investigations at the Labor Department, vetting at ICE of noncitizens in removal proceedings, and *billions* of dollars of other costs annually incurred across the nation’s immigration system? Nope. Doesn’t it seem likely that when Congress authorized an Immigration Examinations Fee Account restricted to “providing immigration adjudication and naturalization services,” it meant “adjudications and nationality” activities of the Examinations branch of INS which is now USCIS? This is a great exaggeration. There are about 30-40K total H-1B visa holders in the entire Dallas-Fort Worth metro area out of a population of over 8 million people so under 0.5% of the population. On the other hand, there are nearly half a million illegal immigrants there.

In Texas I went to a game where the entire student side of the stadium did not sit down for four hours. I assumed the seats were broken. I checked the one next to me. It worked. I asked a student named Tyler why nobody was sitting. He said, "In case they need us." That was the whole answer. In my land we have a saying, always on the battlefield. A samurai does not lounge in the presence of a lord who may call him. He stands, so that when the call comes there is no distance between the call and the man. Here were thirty thousand of them. Standing. In case. I asked Tyler how often they are needed. He thought about it. "Once." Once. In 1922. The team was running out of healthy men, and a student named Gill was called down out of the stands. He put on an injured player's uniform and stood on the sideline, ready, for the rest of the game. He never went in. They won without him. That is the whole origin. A man who did not play. A hundred years of standing for a man who did not play. So I stood. I am not a student. I was not going to be called under any reading of the rules. My knees began filing complaints in the third quarter and I ignored them, because Tyler was nineteen and had stood through every home game for three years and had never once been called, and was not bitter about it, and was in fact eating nachos. Nobody was called. Nobody has been called since 1922. The knees of Texas do not care. In my land we say be ready at every moment. Texas built thirty thousand seats and refuses to use them.

If what @Nero is saying is true, regardless of my personal feelings about him, this shows how grossly weaponized discretion and limited (if any) judicial review can become. If I were him, I would start with a fight to find all communications through FOIA (probably going to have to go through Article III court to get actual transparency) and build from there.

In December, @USCISJoe puts out a policy stating that self-submitted passport sized photographs "will no longer be accepted." Folks are now required to attend an appointment to give biometrics and get a photo taken. Fine, it's a silly policy, but whatever. Yet, Joe has refused to update the Form instructions for forms that would use photographs (I-765, I-485, I-90, N-400, etc.). Earlier this month, USCIS announced a policy that it could deny cases without an RFE if required initial evidence is not submitted. Since Joe Edlow refuses to update form instructions as new ones become available, or even put out a policy saying "hey we don't care about this instruction anymore for any case" it is possible for someone to get a denial for not submitting photographs (required initial evidence) that "will no longer be accepted" by USCIS. Just goes to show the silliness of USCIS.
